In accordance with Article 6 of Regulation (EC) No 396/2005, Austria, herewith referred as the evaluating Member State (EMS), received an application from Sumitomo Chemical Agro Europe S.A.S. to set MRLs for fenpyrazamine for certain crops for which authorisations will be requested. In order to accommodate for the intended uses of fenpyrazamine in Spain, Italy and Greece it is proposed to raise the default MRL from the value of 0.01 mg/kg to the proposed MRLs of 3 mg/kg on table and wine grapes, tomatoes, aubergines, peppers and 0.7 mg/kg on cucurbits with edible peel. Austria drafted an evaluation report according to Article 8 of Regulation (EC) No 396/2005, which was submitted to the European Commission and forwarded to EFSA on 22 March 2011. It is noted that fenpyrazamine is a new active substance for which the peer review process under Regulation (EC) No 1107/2009 is currently ongoing.
